Estimado\/a colegiado\/a,<\/p>\n\n\n\n

le informamos que el Tribunal Supremo en sentencias 1232\/2024 y 1233\/2024, de 3 de octubre, interpreta el art\u00edculo 17.12 de la LPH, declarando que las comunidades de propietarios por la doble mayor\u00eda de tres quintos de propietarios y cuotas de participaci\u00f3n, comput\u00e1ndose el voto favorable presunto de los ausentes que no muestren su discrepancia en el plazo de 30 d\u00edas naturales, pueden acordar prohibir que las viviendas se destinen al uso tur\u00edstico, zanjando as\u00ed la pol\u00e9mica jurisprudencial existente por la diferencia de criterio en las distintas Audiencias Provinciales, sobre el quorum necesario para acordar la prohibici\u00f3n.<\/p>\n\n\n\n
